No charges filed against Dayton officers who shot armed man

A grand jury declined to indict two Dayton police officers who shot a man who reportedly pointed a gun at them.

The man, identified as 46-year-old Eric Grady, suffered non-life-threatening injuries during the shooting in the 900 block of Custer Place on Aug. 23.

One officer fired once and the other officer fired three times, Dayton Police Chief Kamran Afzal previously said. Neither officer was named, but they both had been with the department for 18 months at the time of the shooting and hadn’t had any disciplinary records.

One of the officers had received a letter of commendation.

The officers had been called to the Custer Place twice that night for a report of a man with a gun.

They first responded around 10:50 p.m., but didn’t find him. At 11:36 p.m. the man returned and the two officers responded to the area again.

This time, they found the man, later identified as Grady. Body camera footage captured officers telling him to drop his weapon.

“Both officers discharged their firearms at the suspect after the suspect raised the firearm in their direction,” Afzal said previously.

The officers then provided medical aid until medics were able to transport Grady to the hospital.

He was booked into the Montgomery County Jail on Aug. 27 on weapons charges.

Last week, Grady pleaded guilty to two counts of having weapons while under disability and one count of possession of cocaine, according to Montgomery County Common Pleas Court records. Two additional weapons charges were dismissed.

Grady is scheduled to be sentenced on Jan. 7.
