Greene County jury finds Utah man not guilty of sexual conduct with minor

A Utah man who was reportedly found with a teen inside a Beavercreek hotel room was found not guilty of having sexual contact with a minor following a trial.

A jury acquitted 45-year-old Michael E. Barfuss of Roy, Utah, of two counts of unlawful sexual conduct with a minor, according to Greene County Common Pleas Court records.

The trial began Jan. 21 and the jury began deliberating Friday afternoon. The not guilty verdict was filed on Friday.

In July 2023, hotel staff checked in Barfuss and reportedly saw a teen enter his room.

Hotel employees reported they were concerned and stood outside the hotel room’s door and could hear “moaning” that seemed sexual, according to a Fairborn Municipal Court affidavit.

Police were called to the hotel and knocked on the door. Barfuss reportedly answered shirtless and the teen exited the bathroom without any clothes.

The teen said they met Barfuss on a dating website and the sexual conduct was consensual, but Barfuss said no sexual activity took place, according to an affidavit.
