Miami Twp. man sentenced to prison for shooting roommate over cigarette

A Miami Twp. man accused of shooting his roommate in the mouth after he wouldn’t give him a cigarette has been sentenced to prison.

Damarion Charles Lee, 25, was sentenced by Montgomery County Common Pleas Judge Steven Dankof to five to seven and a half years in prison on one count of felonious assault, followed by up to three years of parole.

He received credit for 325 days already spent in confinement and agreed to forfeit a handgun used in the shooting. At the time of writing, Lee was in the Montgomery County Jail.

The charges stem from Feb. 19, 2024, when Miami Twp. police were called to a reported shooting in a residence in the 6300 block of Saxony Road.

Lee was outside in the snowy yard when police arrived and approached officers with his hands in the air before being detained, according to an affidavit filed in Miamisburg Municipal Court.

Lee’s roommate was found inside with a gunshot to the mouth, the affidavit said.

Investigators said that the pair were in the living room when Lee asked the roommate for a cigarette. The roommate said he wouldn’t give him one, then went to his separate bedroom to lay down, the affidavit said.

According to the roommate, seconds later Lee shot him.

The roommate was taken to a local hospital.
